Law-based governance of the military and strict enforcement of discipline are not simply a management issue; they cover every aspect of China’s efforts to build a strong military.
This initiative was unveiled at the fourth plenary session of the 18th CPC Central Committee in October 2014, as part of an overall strategy to promote the rule of law nationwide. The move, as mandated by a Central Military Commission decision in February 2015, represents a milestone in the development of China’s military judicial system.
It calls for respect for the supremacy of the law and heightened awareness of the importance of the rule of law, and promotes law-abiding practices within the armed forces. It envisions a distinctively Chinese military judicial system that ensures rigorous and efficient enforcement of military laws and regulations through effective implementation mechanisms, accompanied by effective oversight and institutional guarantees. A paradigm shift is required to ensure that the law is respected in all decision-making processes of Party committees, administrative offices and command centers, and in the execution of duties by all military personnel.

依法治軍、從嚴治軍不是單純的依法管理,而是依法建設(shè)、治理和運用軍隊。2014年10月舉行的中共十八屆四中全會,首次將依法治軍、從嚴治軍納入依法治國總體布局,實現(xiàn)了人民解放軍法治建設(shè)的歷史性飛越,是依法治國方略在軍事領(lǐng)域的具體運用。2015年2月,中央軍委印發(fā)《關(guān)于新形勢下深入推進依法治軍從嚴治軍的決定》,對依法治軍、從嚴治軍作出全面部署。依法治軍、從嚴治軍的本質(zhì)要求是法規(guī)至上,它要求人民解放軍強化法治信仰和法治思維,構(gòu)建完善中國特色軍事法治體系,形成系統(tǒng)完備、嚴密高效的軍事法規(guī)制度體系、軍事法治實施體系、軍事法治監(jiān)督體系、軍事法治保障體系,按照法治要求轉(zhuǎn)變治軍方式,形成黨委依法決策、機關(guān)依法指導(dǎo)、部隊依法行動、官兵依法履職的局面,不斷提高國防和軍隊建設(shè)法治化水平。
