??????? 刑事拘留（criminal detention）后撤銷案件放人的情況，到底是否應(yīng)給予國家賠償（state compensation），成為國家賠償法修改中一個難題。
???????4月26日下午，十一屆全國人大常委會第十四次會議在人民大會堂舉行第一次全體會議。提請第四次審議的國家賠償法修改草案（the draft amendments to the State Compensation Law），針對上述難題給出解決方案。
???????法律委員會認為，對于違反刑事訴訟法（Criminal Procedure Law）的規(guī)定采取刑事拘留措施的，應(yīng)當(dāng)明確規(guī)定受害人有取得國家賠償的權(quán)利（be entitled to...）。采取拘留措施的時間超過規(guī)定時限（beyond the legally permitted period），其后決定撤銷案件的，應(yīng)當(dāng)規(guī)定受害人有取得賠償?shù)臋?quán)利。請看新華網(wǎng)的報道：
???????Members of the NPC Standing Committee say the draft amendments should explicitly stipulate that those who have been detained illegally are entitled to compensation. Those who have been detained beyond the legally permitted period should be entitled to state compensation, the members said.

???????國家賠償（state compensation），又稱國家侵權(quán)損害賠償，是由國家對于行使公權(quán)利的侵權(quán)行為造成的損害后果承擔(dān)賠償責(zé)任的活動。
???????現(xiàn)行的《中華人民共和國國家賠償法》于1995年生效。該法第2條規(guī)定：
???????國家機關(guān)和國家機關(guān)工作人員違法行使職權(quán)侵犯公民，法人和其他組織的合法權(quán)益造成損害的，受害人有依照本法取得國家賠償?shù)臋?quán)利。
???????Citizens, legal persons or other organizations have the right to seek compensation from the state if state organs and office holders abuse their power and infringe upon their lawful rights and interests and have caused damages thereof.
